1. Introduction

1.1 These Terms and Conditions ("Terms") govern your use of the KwikAccounts, accounting software ("Software") and any related services ("Services").

1.2 By using the Software and Services, you agree to be bound by these Terms.

2. Definitions

2.1 "User" means you, the person or organization using the Software and Services.

2.2 "Account" means your unique account created to access the Software and Services.

2.3 "Data" means any information, including financial data, uploaded to or generated by the Software.

3. Use of the Software and Services

3.1 You must use the Software and Services for lawful purposes only.

3.2 You must not use the Software and Services to transmit or store any material that is unlawful, threatening, abusive, harassing, defamatory, or obscene.

3.3 You must not use the Software and Services to infringe the rights of others, including intellectual property rights.

4. Account and Password

4.1 You are responsible for maintaining the confidentiality of your Account and password.

4.2 You must not share your Account or password with any third party.

4.3 You are responsible for any activity that occurs under your Account.

5. Data Ownership and Use

5.1 You retain ownership of all Data uploaded to or generated by the Software.

5.2 You grant KwikAccounts  a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the Data for the purpose of providing the Services.

5.3 KwikAccounts may use aggregated and anonymised Data for statistical and analytical purposes.

6. Payment Terms

6.1 You must pay all fees and charges associated with the Services in accordance with the payment terms specified by KwikAccounts.

6.2 KwikAccounts reserves the right to suspend or terminate the Services if you fail to pay any fees or charges.

7. Warranty Disclaimer

7.1 The Software and Services are provided on an "as is" and "as available" basis.

7.2 KwikAccounts disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

8.1 KwikAccounts shall not be liable for any damages, including but not limited to incidental, consequential, or punitive damages, arising out of or in connection with the Software and Services.

8.2 KwikAccounts's liability for damages shall be limited to the amount of fees paid by you to KwikAccounts in the preceding 12 months.

9. Termination

9.1 KwikAccounts may terminate these Terms and the Services at any time without notice.

9.2 Upon termination, you must immediately cease using the Software and Services.

10. Governing Law

10.1 These Terms shall be governed by and construed in accordance with the laws of Republic of South Africa.

10.2 Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the rules of the Republic of South Africa.

11. Changes to these Terms

11.1 KwikAccounts may update these Terms from time to time.

11.2 You are responsible for reviewing these Terms regularly to ensure you are aware of any changes.
